Missouri v Holland international law case study

International Law: Case Study 2
Missouri v. Holland   252 U.S. 416 (U.S. Supreme Court, 1920)

You are to evaluate a public international law case and determine whether and how a treaty might or did effect an outcome.
Treaties often codify customary international law (CIL) as well as introduce new standards and norms. Sometimes, though, treaties may be insufficient or imprecise instruments to address a case at hand. Other times, they are ideal but enforcement or other issues remain a problem.
Your case study should do three things:
1) Firstly, identify and summarize a case
a. Follow the same formula as with Case Study 1.

2) Secondly, identify a relevant treaty and determine its strengths and weaknesses relative to the case:
a. If the case references a treaty, use that.
i. If no treaty is referenced, find one through one of the following sites:
b. Briefly summarize the treaty and its goal(s).
c. Evaluate the treaty as it relates to the case: Is it sufficient to address the questions at stake? Does it offer sufficient enforcement? Does it contradict some other standard or principle in international law?

3) Thirdly, your overall conclusion
a. Is there a larger lesson for international law, here? Is this a limited situation? What are the general potentials and also constraints of treaties on your topic?

Requirements: 3-4 pages long (double-spaced). At least 5 cited sources (includes both course and external sources)

Case Study Format: Title and works cited pages do not count towards this total.  Papers should be double-spaced, Times New Roman 12 point font or Calibri 11 point font with 1 inch margins all around.  You may choose your citation style (such as APA, Chicago, MLA), but you must use that style consistently throughout.  To cite a document retrieved online, use a standard format, do not simply copy and also paste the browser link.

Case Study Grading: I will consider how well you followed directions as well as focused tightly on your given topic; your mastery (i.e. correct understanding and general use) of the readings; your argument’s clarity, consistency and accuracy; the paper’s overall structure and logic; overall clarity and grammar.   We will discuss the papers further as they arise.
