SCENARIO:

Asalah is a Muslim female who has immigrated to the United States with her husband and two children. Her husband is considered moderate and progressive in his ideals. Asalah is working in the female section of the county jail. Although she is progressive, she still feels that she should wear a khimar (type of head scarf), but by policy, this is not allowed within a jail setting.

To follow policy and procedure, she does not wear any covering in the female section but wishes to wear the khimar when coming into and leaving the jail setting because there are males in this institution.

She has just heard from her family that they are coming for a visit. Her family is quite conservative and also realizes that she will not be wearing a burqa but would expect her to wear a khimar.

Yes, this would be discrimination because “The United States Equal Employment Opportunity Commission they have enforced the law that prohibiting religious discrimination in a person workplace (USA.gov). Now if she is being harassed or she doesn’t feel safe then they can put her someplace else for her safety. If her headpiece gets in the way of her job then the employer can ask her to remove it for safety reasons like is, she had a string, or tie knots that hang, but other than that she doesn’t have to take off her headpiece.

If she wears her headpiece around men they might whistle or even make a pass at her, and she would be in danger I would say that if she wants to go to the cafeteria, they should let her go after the men have done left, or they can escort her there. The policy would be the Civil Rights Act of 1991 because it prohibits employers, from discriminating against a person because of religion.
